KFC drops trademark lawsuit against Church's over 'Original Recipe' ads

Dec 17 - Yum! Brands' KFC (YUM.N) told a Texas federal court on Tuesday that it would end its lawsuit over rival fast-food chain Church's Texas Chicken's use of its trademarked phrase "Original Recipe" in advertising.
 
KFC asked the court to dismiss the case without prejudice, which means it could refile the lawsuit later. Spokespeople and attorneys for the companies did not immediately respond to requests for comment and more information, including whether the lawsuit had been settled.
 
KFC said it has been using "Original Recipe" to advertise its fried chicken's secret blend of herbs and spices since 1972. It sued in the U.S. District Court for the Eastern District of Texas last month, alleging that Church's began using the same phrase to advertise its fried chicken in September.
 
The complaint cited Church's ads for chicken legs and thighs that say "Our Original Recipe Is Back." KFC said it told Church's representatives in October that the ads would confuse consumers and diminish "the distinctive quality and value of KFC's famous marks."
 
KFC asked the court for an unspecified amount of monetary damages and an order blocking Church's from using the phrase. Church's did not respond to the allegations.
 
The case is KFC Corp v. Church's Texas Chicken, U.S. District Court for the Eastern District of Texas, No. 4:24-cv-01000.
