The First Mobile Internet Lawsuit on Anti-monopoly on Trial

On November 28th 2014, Beijing Second Intermediate People’s Court opened a court session hearing the case of Beijing Emiage Tech. Co.,Ltd. (Emiage Tech.) suing Qihoo 360 Technology Co.,Ltd (Qihoo 360) for the abuse of market dominance and unfair competition. Being the first lawsuit on anti-monopoly in the mobile Internet industry in China, particularly after the well-known legal battle between Qihoo 360 and Tencent, this case drew great public attention. According to Emiage Tech., two applications developed by the company have been frequently intercepted and blocked by the mobile Internet application “360 safe guard” from Qihoo 360, a security monitoring software on cell phone which has a dominant position in the Chinese market. Failed to receive a timely and positive response from Qihoo 360, Emiage Tech. bring the lawsuit in front of the court, requiring the defendant to stop the infringement immediately, make an apology to eliminate all negative effects as well as compensate 500 million yuan for the economic loss. Delayed for several time, the case is now officially put on trial.
