More Chinese famous brands preemptively registered in Chile

According to the Ministry of Commerce of P.R. China, the phenomenon that Chinese famous brands have been preemptively registered in Chile has been gradually obvious in recent years.

As Chile has not entered into some international trademark treaties, such as Madrid Protocol, Chinese famous brands can not receive effective protection there.

After consulting with local lawyers in Chile, we know that, in term of the law of Chile, if the registration of this kind is successful, the offenders will own all relevant rights about the trademark, including manufacturing, selling, import and export, which will greatly harm China's brands with independent intellectual property rights.

So, the commerce ministry suggests that those Chinese enterprises having intention to explore the market in Chile should register their trademarks there in time to avoid loss. [Chinese version is available on MOFCOM.gov.cn]
