It is reported that, China (Chongqing) Tianfu Cola Group Co. has sued Pepsi for illegally occupying the technology secret and the case was formally accepted and heard by the court on October 28.
“We have to take such action,” said the founder of Tianfu Cola Li Peiquan on November 3. “If we could succeed at this stage, our goal for the next step is to seek our trademark of ‘Tianfu Cola (天府可乐)’. ”
In 1994, Tianfu Cola signed a contract with Pepsi to invest 1,800 US dollars to Chongqing Pepsi-tianfu Beverage Limited Company (joint venture). “As the investment did not include the prescription and process technology, Tianfu asked the defendant to stop illegal using and return them immediately,” said president of H&J VANGUARD.
“We have much confidence in the suit. If we do succeed, Tianfu Cola will then focus on claiming the trademark rights.”
“Tianfu Cola brand has never been transferred to Pepsi,” said Li Peiquan repeatedly. “We just allowed the joint venture company to use it under certain conditions at the price of 3.5 million, not the ownership for the brand.”
