Rosemount Inc. sues Shanghai RSMT for trademark infringement

On 8 April, the Shanghai 1st Intermediate People's Court held a trial on the case in which American Rosemount Inc. sued Shanghai RSMT Instrumentation Co., Ltd. for trademark infringement.

Rosemount Inc., a leading company in the design and manufacture of instrumentation, is a division of Emerson Electric Co. Since the 1970s, Rosemount's products have entered the Chinese market.

According to Rosemount Inc., the registered English mark and its Chinese translation used by the defendant were similar to Rosemount's registered marks. The defendant also confused the public by providing misleading information, such as the package and source of the products, on its website. Rosemount Inc. requested the court to order that the defendant should permanently stop manufacturing, advertising for or selling the pressure transmitters which bore the trademark "罗斯蒙特" or similar characters, compensate RMB 500,000 and pay for the plaintiff’s costs of the action.

The court will announce the judgment after deliberation.
