Recently Yalong Paper Products (Kunshan) Co. Ltd. instituted a proceeding against the Beijing Modern Plaza which was suspected of selling counterfeit printing paper. On July 10, the Haidian District People's Court in Beijing accepted the case.
Yalong Paper Products (Kunshan) Co. Ltd. is an enterprise under the well-known Sinar Mas Group. Yalong owns the registered trademark "旗舰" (flagship) which has been identified as a "Well-known Trademark" in China. In March 2007, Yalong found that counterfeit printing paper bearing the trademark representation "旗舰" were sold in Beijing Modern Plaza.
According to Yalong, the defendant should have strictly checked the sources of goods sold in the plaza; however, the defendant misled the consumers by selling counterfeit goods and infringed the plaintiff's legal rights and interests. Therefore, the plaintiff requested the court to order that the defendant should stop selling the infringing goods, make an apology and compensate 510,000 Renminbi.
