Anhui to legislate on well-known trademark recognition

According to Legislative Affairs Office of Anhui Province, Anhui will legislate on the identification of well-known trademarks so as to protect the legitimate rights and interests of the trademark owners and users.

At present, "Anhui Well-known Trademark Identification and Protection Regulations (Draft)" has been published online and solicit opinions from the whole society. The public may give feedback to the Legislative Affairs Office before July 10.

The "Regulations" prescribes that identification of famous trademark shall adopt the principle of voluntary application; the trademark shall be in continuous use for three years after registration and shall not be involved in any dispute; the sales, tax, profit, market share and other major economic indicators shall be in the forefront of the same industry in the past three years.

The industry and commerce administrations shall publish the qualified applications in governmental newspapers, posts or websites for a period of 30 days.
If the public demur at the application, the industrial and commercial administrative departments should conduct investigation. If the objection is established, the application shall be rejected, or else the application shall be assessed. [Chinese version is available on Jianghuai Morning News]
