Two storekeepers fined for selling infringing Nippon paint

On June 2, the Wuzhou Administration for Industry and Commerce in Guangxi Province delivered penalty decisions to two infringers who infringed the registered trademark "立邦" (which means "Nippon"). The AIC determined to confiscate all the infringing paint and imposed a fine on each infringer.

In March, complaint received by Wuzhou AIC indicated that counterfeit paint was sold in two decoration material stores. Then officials from Wuzhou AIC examined the stores. The officials found that Su, one of the infringers, decorated his store with advertisements bearing the words "立邦涂料" (which means "Nippon Paint"). Su also put up a fake licensing certificate on the wall. In the store, the officials seized 221 bottles of infringing paint, with a value of RMB 30,000. In another store owned by Zhang, the officials detained 41 bottles of infringing paint for wooded furniture.

Investigations by Wuzhou AIC showed that the infringers purchased the infringing paint from Foshan and Jiangmen in Guangdong Province. The AIC established that the acts of the infringers had seriously infringed the legal rights and interests of Nippon Paint (China) Co. Ltd.
