On June 29, the Minxing District People's Court in Shanghai sentenced Liu Huaxin, legal representative of Shanghai Wanpu Cable Co. Ltd., to a two-year imprisonment with a penalty. Liu Huaxin was convicted of using a trademark that was identical with others' registered trademarks for identical commodities.
Investigations indicated that Shanghai Wanpu Cable Co. Ltd. was under Liu's individual operation. From April 2005 to April 2006, without the permission of Tyco Electronics (Shanghai) Co. Ltd., Liu used the representations of Tyco's registered trademarks "AMP" and "AMPCONNECT" on 2881 boxes of cables. He sold the above products to several companies or individuals, involving more than RMB 780,000 yuan.
In April 2006, without the permission of CommScope Inc., Liu manufactured 250 boxes of cables that bore the trademark representation of "SYSTIMAX" and sold the products to a company in Changzhou of Jiangsu Province.
In April and June 2006, inquired by the Administrative for Industry and Commerce and the police, Liu confessed his act of manufacturing counterfeit products.
