Recently the Pudong District People's Court in Shanghai sentenced Fan Renyao, who sold counterfeit goods bearing the representations of 10 registered trademarks, to a 22-month imprisonment with a 30-month suspended sentence and a fine of RMB 30,000 yuan.
In March 2007, the Pudong People's Procuratorate instituted public prosecution against Fan Renyao for selling counterfeit goods. According to the Procuratorate, in June 2005, Fan started selling counterfeit goods that bore the representations of registered trademarks in a rented room in Pudong District. In August 2006, officials from the Pudong Administration for Industry and Commerce seized in the room more than 300 pieces of counterfeit goods with a value of RMB 2,394,030 yuan, involving 10 registered trademarks like LV, PRADA, OMEGA, GUCCI, ROLEX, BALLY and CHANEL. The Procuratorate held that Fan should bear the criminal liability for knowingly selling a large number of counterfeit goods which bore the representations of registered trademarks.
The court supported the Prosecution by the Procuratorate and convicted Fan of the crime of selling commodities that bore counterfeit registered trademarks.
